Terms of Service — KIT3

KIT3 is a small, personal photo-exchange app for staying in touch with close friends, operated by Andrew Valko ("we"). By using the App you agree to these terms.

The service

KIT3 lets you exchange a small number of photos and short status notes with friends you explicitly connect with, on a weekly cadence. It is provided free of charge, as a personal project, on a best-effort basis.

Your content

• You keep all rights to the photos and text you share. You grant us only the limited license needed to store and deliver them to the friends you send them to.
• Only share content you have the right to share, and that you're comfortable sharing with your connected friends.
• You are solely responsible for the content you share and for your interactions with other users. We do not monitor, endorse, or take responsibility for content shared by users, and content shared by another user is their responsibility, not ours.

Acceptable use — zero tolerance for objectionable content

There is zero tolerance for objectionable content or abusive users. You agree not to post, send, or share content that is unlawful, harassing, threatening, hateful, sexually explicit, or otherwise objectionable, and not to harass, abuse, impersonate, or harm anyone.

• Reporting: you can report any photo or comment by pressing and holding it in the App.
• Our response: we review every report and act within 24 hours — objectionable content is removed, and the responsible user may be suspended or permanently removed.
• Ending a connection: every connection in KIT3 is mutual. You can end a connection with anyone at any time from that friend's screen, which immediately stops all further contact and content from them.
• No attempts to access other users' data or disrupt the service.

No warranty

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee uninterrupted or error-free availability, and photos may be periodically deleted per the App's weekly cadence. Keep your own copies of photos you care about.

Limitation of liability

To the maximum extent permitted by law, Andrew Valko (the operator) will not be liable for any indirect, incidental, special, exemplary, or consequential damages, or for any loss of data, content, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App, or arising out of content shared by you or by any other user — whether based on warranty, contract, tort, or any other legal theory, and even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the App will not exceed the amount you paid to use it (which is zero). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Andrew Valko from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with the content you share, your use of the App, or your violation of these terms or of any law or the rights of any third party.

Termination

You can stop using the App and request deletion of your data at any time (see the Privacy Policy). We may discontinue the service with reasonable notice.

Governing law

These terms are governed by the laws of Denmark.

Changes

We may update these terms; material changes will be noted on this page.
